POLICY OF ALLOTMENT AND APPROPRIATE USE OF THE STAFF QUARTERS/FLATS OF THE DIRECTORATE OF TRAINING, GNCTD

1.INTRODUCTION

The Policy has been framed to serve the wider interests of the Directorate of Training and to regulate the allotment of the staff quarters/flats (being separate and not a part of the general pool accommodation of PWD, GNCTD) in the residential complex of the Directoratein such a way that aims and objectives of the training are effectively met and achieved both by the trainees and staff/officers of the Directorate with least inconvenience to them during their training period and tenures respectively.

3. ALLOTMENT OF STAFF QUARTERS/FLATS TO THE REGULAR STAFF/OFFICERS

  1. The regular staff/officers i.e. posted by the Services/Finance Department of GNCTD on transfer to the Directorate of Training or directly recruited by GNCTD for the Directorate or appointed on deputation and ex-cadre staff of the Directorate shall be entitled to the staff quarters/flats in the residential complex.Allotment shall be made in accordance with the entitlement of the officer/official to particular category of staff quarters/flat as per rules, on availability of that type of staff quarters/flats and also as per decision of the Competent Authority of the Directorate of Training, i.e. Principal Secretary (Training).
  2. Irrespective of the entitlement of regular staff/officers of the Directorate to the staff quarters/flats, the Directorate may not allot/get vacated such type/types and number/numbers of staff quarters/flats for the purposes of converting into guest house/houses or otherwise use as it may consider necessary and essential.
  3. Normally, request from the regular staff/officers of the Directorate for allotment of category of staff quarters/flats higher than their entitlement shall not be entertained.However, in cases deserving special consideration, namely, pressing medical grounds, genuine responsibility of aged parents, educational needs of children at crucial stage etc. request for higher category of staff quarters/flats may be considered by the Competent Authority.This would be subject to availability.
  4. For purposes of allotment of staff quarters/flats, the Estate Branch of the Directorate of Training shall, henceforth, start preparing list of staff/officers’ in accordance with the date of receipt of the applications as and when received.

4. ALLOTMENT OF STAFF QUARTERS/FLATS TO PROBATIONERS

  1. With a view to providing convenience to the married IAS (AGMUT)/DANICS probationers undergoing long term District Training in the GNCTD/long term Foundation Course in the Directorate of Training 5 (Five) Type IV staff quarters/flats may be earmarked as married accommodation.In addition 2 (Two) Type III staffquarters/flats may also be considered for allotment to married probationers, if not requested by the regular staff of the Directorate and vacant.This shall, however, be done only in exceptional circumstances, i.e., specific request by married IAS (AGMUT)/DANICS probationer, his/her needs and satisfaction of the Competent Authority of such needs. Latter’s decision in such cases shall be final.
  2. The allotment of staff quarters/flats as in para 4(i) above shall be purely temporary, i.e., for the period of training/extended training and subject to such conditions as given herein or such new conditions which the Competent Authority may decide in larger interest of trainings and all probationers together.
  3. For purposes of allotment of staff quarters/flats to the married probationers, the Estate Branch of the Directorate shall consider the date of receipt of application/request from married probationer as the basis to draw a list of applicant probationers.Priority of allotment, out of the said list, may be accorded to those married probationers (a) who hail from states far distant from Delhi and far beyond NCR. (b) who having joined the Directorate and have more than 12 months of training/extended training left (c) who have small children/aged parents having no other alternative place.Decision of the Competent Authority in matter of allotment shall be final.
  4. Irrespective of the above provisions of allotment of staff quarters/flats, no request for allotment shall be entertained from married probationers during the initial six months of the training period in the Directorate.
  5. During initial six months, all probationers shall have to compulsorily stay in the Hostel. Allotment of Hostel shall be governed by the terms and conditions as laid out in Order No.4(2)/2010/UTCS/CT/31777-82dated 19.11.2010.
  6. Request for allotment of married accommodation from married probationers shall be entertained only after expiry of six months and consideration of such request shall be in accordance with the criteria provided in paras 4 (i) (ii) and (iii) above.

5.LICENCE FEE AND OTHER CHARGES

  1. The allottees (regular staff/officers and married probationers) as the case may be, shall becharged licence fee fixed as per PWD norms in respect of each category/type of quarters/flatsand as per rules governing category higher than entitlement.Licence fee shall be subject torevision in accordance with PWD rates as and when revised by the Government.As per rules,allottees shall not be eligible for House Rent Allowance.
  2. The Licence fee shall be deducted directly from the monthly salary of the regular staff/officersof the Directorate and married probationers availing residential accommodation.It shall bereflected in the salary slip separately.
  3. For Guest house/houses and other usage of any category of staff quarters/flats not allotted bythe Directorate/reserved for the purpose separate policy decision shall be taken.
  4. Allottees (regular staff/officers and married probationers) shall have to get electricityconnection and electricity meter themselves.Till such time basic electric work of laying ofcables, erection of transformer and panels etc. is done for installation of electric meters,monthly charges as fixed/revised by the Directorate towards electricity shall be charged by theDirectorate.Similarly, water charges as fixed by the Directorate shall also be charged fromthe allottees.
  5. After installation of electricity meters by the allottees (regular staff/officers and marriedprobationers), responsibility of payment of metered charges to DISCOMS shall be of theallottees.They shall also be responsible individually for charges/penalties for load violationsand other violations under applicable Electricity Act and Rules.
  6. Allottees (regular staff/officers and married probationers) shall have to submit No DuesCertificate (NDC) about Electricity and Water charges at the time of vacation of theaccommodation.Without NDC, vacation slip of the quarters/flat shall not be issued by theEstate Branch of the Directorate and Licence Fee as applicable for whole month/months shallbe charged.

6.RETENTION OF STAFF QUARTERS/FLATS AFTERTRANSFER/REPATRIATION/CONCLUSION OF TRAINING ANDPOSTING

  1. Regular staff/officers of the Directorate allotted quarters/flats may be allowed to retain the accommodation in the event of their transfer/repatriation from the Directorate of Training to other Department of GNCTD/parent Department.However, retention of the accommodation shall be allowed only after prior permission of the Competent Authority.Retention of quarters/flats without permission shall be treated as unauthorized occupation entailing such action against the allottee as the Competent Authority may consider fit to be initiated.
  2. Regular staff/officers of the Directorate allowed to retain the quarters/flat shall ensure regular payment of applicable licence fee and other charges towards electricity, water etc.They shall also observe such terms and conditions as laid down by the Directorate including those which the Directorate may incorporate subsequently and covering the period of retention.
  3. Permission to the category of allottees as stated in para (i) and (ii) above to retain the Directorate’s quarters/flat shall stand automatically withdrawn after 30 days of allotment of general pool accommodation ofPWD, GNCTD/GOI or another departmental accommodation.If the allottee fails to inform the Directorate about allotment of general pool accommodation as stated above monthly market rent (as per PWD norms for the area/Delhi) towards allotted quarters/flat shall be computed from the date of expiry of 30 days and charged till actual vacation and handing over of flat to the Directorate.Eviction proceedings may also be initiated.
  4. If the permission to retain the quarters/flat is not granted by the Competent Authority, the allottees shall have to vacate and hand over the quarters/flat to the Directorate within 60 days of his/her formal relieving from the Directorate/repatriation to his/her parent department.After expiry of 60 days such officers/official shall be charged monthly market rent (as per PWD norms for the area/Delhi) towards the allotted quarters/flat till he/she actually vacates the accommodation and hand over to the Directorate.Eviction proceedings may also be initiated.
  5. In the event of superannuation of the regular staff/officer of the Directorate retention of quarters/flats for not more than six months shall be allowed on payment of applicable licence fee and other charges towards electricity and water etc.
  6. In case of probationer allotted married accommodation tenders resignation during the period of training, he/she shall have to vacate and hand over the quarters/flat to Directorate immediately after acceptance of his/her resignation or on expiry of such period of notice to the Competent Authority in the Government as prescribed by the Ministry of Home Affairs.However, in the unfortunate event of death during the period of training, the family of the deceased may be allowed to retain the quarters/flat for maximum three months on payment of licence fee and other charges.
  7. After completion of training probationers allotted married accommodation shall vacate and hand over the quarters/flat to the Directorate within 60 days from the date of relieving from the Directorate.After the stipulated period of 60 days monthly market rent (as per PWD norms for the area/Delhi) shall be charged till actual vacation and handing over of the quarters/flat to the Directorate.Eviction proceedings may also be initiated against the allottee.

7.GENERAL CONDITIONS

  1. Allottees (regular staff/officers and married probationers) shall use the quarters/flats allotted to them only for bonafide use of residence.Bonafide use shall mean that the allottee shall stay in the accommodation alongwith family members.It shall also mean that the accommodation or any part thereof shall not be sub-let in any overt/covert manner by the allottee.It shall also mean that allotted accommodation or any part thereof shall not be used for any non-residential/commercial/any type of storage purpose/any activity offensive to other allottees and the Directorate of Training.
  2. In the event any allottee is reported and found to be indulging in the misuse as indicated in para 7(i) above, allotment shall be cancelled and action as deemed fit shall be initiated against the allottee.
  3. The allottees shall maintain their respective quarters/flats in good condition.Any damage caused to the structure and attributable to the allottee or his/her dependents shall have to be made good by the allottee himself/herself.
  4. The allottees shall not make any additions/alterations/demolitions in the allotted flats/quarters.Such acts shall attract punitive action including cancellation of allotment of quarters/flats.
  5. The allottees and his/her dependents residing with him/her shall maintain peace, harmony, good neighbourliness in the complex.Instances of misconduct shall attract strict action against such allottees including cancellation of his/her allotment.
  6. The allottees shall not harm any tree and plants within the residential complex.They shall also not disturb the area allocated for nursery.Any instance of harming the trees, flowerbeds, plants etc. shall be viewed seriously and action as per rules shall be initiated against those found guilty.
  7. The Directorate of Training would not entertain any request for extra facility i.e. other than already provided within each quarters/flats or the residential complex by the PWD as per their norms.
  8. The Directorate of Training shall also take no responsibility for cleanliness of the individual quarters/flats or the common areas.The allottees may themselves make their own arrangements for cleanliness of the residential complex to ensure healthy conditions against any health hazards.
  9. Similarly, responsibility of safety and security of personal belongings, valuables etc. shall be of the allottee himself/herself.
